A new book by lawyer Michelle le Roux and Judge Dennis Davis examines the fact that political battles have increasingly played out in the courts in South Africa. Political parties have been at odds, citizens have tried to demand services through lawsuits and ANC factional battles have moved to the courts. But the authors of Lawfare: Judging Politics in South Africa, say there is a danger to the ascendency of lawfare. They argue that you cannot govern and shape society through the courts. They also examine the growing debate around the constitution of South Africa. We’re joined by the co-authors of Lawfare, Professor and Advocate Michelle le Roux and Judge Dennis Davis.
